1. Agreement to these Terms

These Terms of Use apply to the Pass New Jersey app on iPhone, Android and the web, this website, its calculators, cheat sheets, emails, Field Guide articles, practice questions and study tools (together, the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Educational exam prep only

Pass New Jersey is a study tool for the New Jersey real estate salesperson exam. It is not the New Jersey Real Estate Commission, the New Jersey Department of Banking and Insurance, PSI Services or any other government or testing body. It is not a licensed prelicensing school, does not provide the required 75-hour course and is not a professional service.

3. Independent and unofficial

Pass New Jersey is independent and has no official role in licensing or testing. Always confirm requirements, fees and rules with the official New Jersey and PSI sources before you rely on them.

4. No professional advice

Nothing in the Service is legal, tax, lending, appraisal, brokerage, title, insurance or closing advice. Do not use it to make decisions in a real transaction. Talk to a qualified professional instead.

5. Accuracy, updates and errors

We work hard to keep content accurate and current, but laws, rules, fees and exam outlines change, and we cannot guarantee that everything is complete or error free at all times. Check official sources for anything important, and if you spot an error, tell us through the contact page.

6. No exam or license guarantee

Using the Service does not guarantee that you will pass the exam, get licensed, improve your score or achieve any business result.

7. Calculators and study tools

Calculator results, quiz scores, readiness scores and study plans are practice estimates. Check your inputs and results, and do not rely on them where they conflict with official sources or for any real transaction.

8. Purchases and refunds

• The app, once launched, is free to download and includes free features. Full access requires a one-time Premium upgrade. Nothing can be purchased until the app launches.
• Premium gives you lifetime access to the paid features on iPhone, Android and the web, including future updates, for as long as we offer the Service. There is no subscription.
• Prices may vary by region, platform, taxes or promotions.
• In-app purchases are processed by Apple or Google. Web purchases are processed by our payment provider, which may act as merchant of record.
• We do not issue direct refunds for Premium. Except where the law or an app store's policy requires otherwise, purchases are final. Refund requests for in-app purchases go to Apple or Google under their policies.
• Premium is a personal, limited, non-exclusive, non-transferable license to use the paid features for your own exam prep. It may be suspended or ended if you violate these Terms.
• We may change which features are free and which are part of Premium.

9. Accounts and security

Keep your sign-in details safe. You are responsible for activity on your account. Do not share or transfer your access. If you think your account has been compromised, tell us right away.

10. Intellectual property

The questions, explanations, guides, designs and other content in the Service belong to Pass New Jersey or its licensors. You may use them for your own personal study only. Copying, scraping, reselling, distributing or using the content to train artificial intelligence models is not allowed without our written permission.

11. Acceptable use

You agree not to:

• Use the Service unlawfully or abusively
• Share your access with others
• Scrape, copy or redistribute content
• Interfere with or disrupt the Service
• Remove notices or attributions
• Present Pass New Jersey materials as official guidance from any government or testing body

12. Third-party services and links

The Service links to and relies on third parties, including app stores, payment providers and official websites. We are not responsible for their content, policies or services.

13. Privacy

Our Privacy Policy explains how we collect and use information and is part of these Terms.

14. Changes to the Service or these Terms

We may change the Service or these Terms at any time. We will update the date at the top when we change the Terms. Continuing to use the Service after a change means you accept it.

15. Termination

We may suspend or end your access if you violate these Terms, misuse the Service or create risk for us or other users. When access ends, your right to use the Service ends too.

16. Disclaimer of warranties

To the extent the law allows, the Service is provided "as is" and "as available," without warranties of any kind, including accuracy, fitness for a particular purpose or uninterrupted operation.

17. Limitation of liability

To the extent the law allows, Pass New Jersey is not liable for indirect, incidental or consequential damages, including a failed exam or a delay in licensing. Our total liability for any claim is limited to the amount you paid for Premium.

18. Dispute resolution

Any dispute will be resolved by individual, binding arbitration administered by the American Arbitration Association, rather than in court. You and we each waive the right to a jury trial and to bring or join a class action. Either side may still bring an individual claim in small claims court or seek injunctive relief for misuse of intellectual property.

You may opt out of arbitration by sending written notice through the contact page within 30 days of first using the Service.

19. Indemnity

You agree to indemnify Pass New Jersey against claims arising from your misuse of the Service, your violation of these Terms, your infringement of others' rights or your use of the Service outside its educational purpose.

20. Governing law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. Disputes that are not subject to arbitration will be heard in the state or federal courts located in New Jersey, unless the law requires otherwise.

21. Acknowledgment

By using the Service, you confirm that you have read and agree to these Terms and that you are responsible for verifying information with official sources.
